《人民法院关于在审理经济纠纷案件中涉及经济犯罪嫌疑若干问题的规定》新旧对照
《中华人民共和国民法典》已于2021年1月1日正式施行,为确保统一正确适用这部固根本、稳预期、利长远的基础性法律,人民法院对标民法典立法精神和法律规定,以“凡是与民法典规定不一致的,坚决废止;同时,立足司法审判实践,该修改的修改,该重新制定的重新制定”为原则,对新中国成立以来的(截至2020年12月30日新闻发布会之前)共计591件司法解释及相关规范性文件进行了全面清理。
此外,人民法院按照“统一规划、分批制定,急用先行、重点推进”原则,制定了与民法典配套的批(共7件)新司法解释,并修改了《民事案由规定》,均已与民法典同步施行。事实上,人民法院全面清理的591件司法解释及相关规范性文件本身并不限于民事规范的范畴,而是以贯彻实施民法典为契机,对所制定的全部司法解释和规范性文件进行的系统性清理。毋庸讳言,人民法院的上述工作在为民法典准确实施保驾护航的同时,也为广大法律工作者学习民法典增加了颇重负担。民法典实施已有一段时间,但因前述司法解释对既往裁判规范的“修改”或“删除”,使广大法律工作者对以民法典为中心所构建的民事法律规范体系尚显陌生,诸多变化对司法实务的影响仍值得进一步研究。
