作者简介

郭锋,法学博士,教授,博士生导师。现任人民法院研究室副主任、一级巡视员。从20世纪80年代开始,在中国人民大学、中央财经大学长期致力于民商法、票据法、公司法、证券法、金融法研究与教学。在2008年发起创办中国法学会证券法学研究会,担任会长至今。从2015年开始,全程参加全国人大常委会法工委组织的民法典编纂工作。现担任人民法院民法典贯彻实施工作领导小组办公室副主任,具体承担民法典贯彻实施、司法解释清理与制定的统筹管理工作。

 

周伦军,人民法院民二庭审判长,院民法典贯彻实施工作领导小组办公室成员,兼任中国法学会审判理论研究会商事审判专业委员会副秘书长,长期从事民商事审判调研指导工作。

 

陈龙业,人民法院研究室民事处处长,院民法典贯彻实施工作领导小组办公室成员,法学博士,主要从事民商事综合调研指导和侵权法、物权法领域的研究。

党的十八届四中全会提出编纂民法典的重大立法任务。编纂民法典是通过对我国现行的、制定于不同时期的民法通则、物权法、合同法、担保法、婚姻法、收养法、继承法、侵权责任法和人格权方面的民事法律规范,进行系统整合、编订纂修,形成一部适应新时代中国特色社会主义发展要求,符合我国国情和实际,体例科学、结构严谨、规范合理、内容完整并协调一致的法典。以习近平同志为核心的党中央高度重视民法典编纂工作,将编纂民法典列入党中央重要工作议程,并对编纂民法典工作任务作出总体部署、提出明确要求。从2015年3月启动民法典编纂工作开始,经过5年努力,后将民法总则与经过审议和修改完善的民法典各分编草案合并,形成《中华人民共和国民法典(草案)》,提请2019年12月召开的第十三届全国人大常委会第十五次会议审议。
