2015年8月29日《刑法修正案(九)》通过后,许多刑法工具书都及时更新再版,我也顺势推出了《刑法规范精解集成》(第三版)。相比第二版,第三版在编纂理念和具体内容方面,均有了质的飞跃和长足的进步。在本书第三版面市后不到一年即又推出新版,则缘于一个重大司法解释,即“两高”于2016年4月18日颁布的贪污贿赂司法解释。
《刑法规范精解集成》(第四版)继续保持了独创的“点对点式”注释体例,而在内容方面则新收录了“刑九”后至2016年4月颁布的6个新的司法解释,分别为《人民法院、人民检察院关于办理贪污贿赂刑事案件适用法律若干问题的解释》《人民法院关于审理毒品犯罪案件适用法律若干问题的解释》《关于审理抢劫刑事案件适用法律若干问题的指导意见》《人民法院、人民检察院关于办理妨害文物管理等刑事案件适用法律若干问题的解释》《人民法院、人民检察院关于办理危害生产安全刑事案件适用法律若干问题的解释》和《人民法院关于〈中华人民共和国刑法修正案(九)〉时间效力问题的解释》。
作为一位执业多年的刑辩律师,我发现了一个有趣的现象,控辩双方真正的争议焦点,往往是总则问题,而不是分则问题。分则问题通常是表面问题,不易产生争议,而总则问题才是真正值得讨论的深层问题。基于这一认识,本书第四版特意将个罪司法解释中涉及总则问题的内容摘录出来,再次用于注释刑法总则的相关内容。例如,将走私犯罪司法解释中关于“既遂和未遂”的内容,用于解释刑法总则中的“未遂”;将洗钱罪、走私罪和掩饰、隐瞒犯罪所得罪等司法解释中关于“明知”的内容用于解释刑法总则犯罪故意;将散落在赌博犯罪、危害药品安全犯罪等司法解释中各种形形色色的“帮助行为”来注释刑法总则共同犯罪中的帮助犯。我认为,司法实务工作者要更加重视刑法总则问题的学习,学会运用分则来解释总则,再运用总则原理来创造性地解决分则问题。
目前市面上的刑法工具书主要有李立众主编的《刑法一本通》(第十二版)、刘志伟主编的《刑法规范总整理》(第九版)和本人编纂的《刑法规范精解集成》(第四版),还有刚于2016年新出版的,如田申主编的《刑法e本通》和赵权主编的《刑法适用一本通》。刑法工具书的共性是内容,而个性是体例。内容决定形式,形式为内容服务。就内容而言,刑法典和刑事司法解释之间存在着主从关系,这种主从关系的表达形式,则完全取决于编纂者如何理解和把握刑法典和刑法司法解释之间的主从关系,不同的刑法工具书体例反映了编纂者对这种主从关系的不同认识。至于哪一种认识更准确,哪一种体例,则悬而未解,也许本身就没有一说,刑法工具书体例的多元化现象本身就说明了这一问题。目前刑法工具书之间的体例差异越来越大,司法实务工作者如能同时比较和参照各种不同体例的刑法工具书,分享不同编纂者的思想,将能更加全面地检索法律信息,也将更加准确地理解和把握好具体的法律问题。
