如果是夫妻一方婚前购买的房屋，夫妻一方以个人财产支付的首付款，其余款项在银行贷款，婚后由夫妻共同偿还，房屋登记在支付首付款的一方名下，那么离婚时房屋的归属，根据《婚姻法司法解释(三)》的规定，应当按照下列原则处理：
一、房屋的归属，首先由双方协商解决
处分财产是当事人的自由行为，只要双方协商一致，司法机关对此并不予以干涉。关于房屋的归属，首先应当由双方协商解决。如果双方能够协商成功，就无须法院判决。
二、协商不成的，法院应当判决归房屋登记方所有
如果双方协商不成，《婚姻法司法解释(三)》首次明确了归不动产产权登记一方所有。
在之前的法律实践中，各地判决没有统一的标准。有的法院以房产证下发的时间为准，如果房产证下发时双方已经登记结婚，就视为夫妻共同财产，其中婚前一方支付的首付款，视为夫妻一方的财产;如果房产证下发时，夫妻尚没有登记结婚，就视为一方财产，只是婚后还贷部分属于夫妻共同财产。还有的法院认为，由于婚后双方共同还贷了，因此房屋属于夫妻共同财产。
因此，人民法院在综合调研的基础上，明确规定，如果一方支付了首付款并且将其登记在自己名下，那么房屋归不动产产权登记一方所有。
