《实务刑法评注》自2022年8月出版以来，已一年有余。一年多来，我国刑法立法和司法政策均有“大动作”：在立法层面，《刑法修正案（十二）》颁布施行，将加大对行贿犯罪的惩处力度，增加惩治民营企业内部人员腐败相关犯罪；在司法层面，“两高”和有关部门发布近10件司法解释、近30件规范性文件、超过50个指导性案例，涉及刑法条文的适用。这就使得第一版《实务刑法评注》已不能充分满足刑事司法实务所需，修订推出第二版成为必然。第二版悉数增补最新刑法条文和司法规则（亦增补了此前遗漏的个别相关规定、规范性文件），并对原有规则作了衔接的必要技术处理、厘清规则层级，方便快速查找；同时，增补法律适用问题答复、复函和《刑事审判参考》新增案例规则（截至第136辑第1542号案例），梳理收录《职务犯罪审判指导》相关内容，进一步完善非规范层面的规则。作此修订后，第二版的篇幅略有扩充（增加33万字），可以准确反映当下我国刑法及其适用规则的最新面貌。
一、法律评注与刑法工具书的编著缘起
德国法律评注（Kommentar）文化高度繁荣，引发我国法律界、特别是学术界的高度关注。评注针对现行法，服务实践，成为德国法律人案头常备的专业“词典”，属于必不可少的工具书。然而，法律评注在德国的发展也历经曲折，十九世纪下半叶，德国法学界主流观点认为不值得在研究当下立法上花费过多精力，甚至存在对评注的抵制。进入二十世纪，德国法学开始关注现行法，形成实践导向的学术与学术导向的实践之结合，使得法律评注兴盛发展。可以说，法律评注最初是实务人士写给实务人士使用的出版物，在发展过程中扩展到了学术界，最终上升为所有法律职业对话的平台与必要的载体，解决了法学理论与实践脱节的问题，为法律适用的统一提供了保障。法律评注的灵魂在于为司法实践服务,由此衍生出一系列关键特征,包括以解释现行法为中心、竭力回答一切问题、重视案例甚于学说和秉承法教义学的方法。
根据规模与内容定位，德国法律评注可以分为大型、中型、小型评注。就大型刑法评注而言，莱比锡评注（Leipziger Kommentar）、体系评注（Systematischer Kommentar）、慕尼黑评注（Münchner Kommentar）被称为德国刑法评注的三大巨作，如莱比锡评注厚达十几卷，超过一万页。中型刑法评注，如勋克/施罗德评注（Schönke/Schröder Kommentar），其自1942年创立，至2019年已经出版到第30版，篇幅达到3361页。小型评注一般都是单卷本，能够放到公文包随身携带，特别是可以开庭时携带，如德国最负盛名的小型刑法评注当属费舍尔评注（Fischer Kommentar），其由法官费舍尔独立完成，也有将近三千页，但开本明显小于勋克/施罗德评注。
通常认为，法律评注以成文法为对象。作为成文法国家，中国法律注释的传统久已有之。新近以来，围绕刑法，理论的“评”与实务的“注”均已出现。于笔者而言，如何融合“评”与“注”，使之成为一部理想的刑法工具书，这一念头由来已久。笔者作为一名刑事司法工作者，因为工作需要，不同刑法工具书的各种版本基本都使用过；工作之余，也一直在琢磨一线实务同行所需的刑法工具书的理想样貌，于是便有了这本《实务刑法评注》。
