刑事责任年龄
在故事中，我们讲到了一个法律术语，叫作“刑事责任年龄”，它是指承担刑事责任所要达到的年龄。刑法把刑事责任年龄划分为四个阶段，让我们一起来看看吧!
第一个阶段是不满14周岁的人，一律不负刑事责任。比如，故事中的小宇，是一名小学五年级的学生，只有11岁，即使他真的偷了东西，也不会构成盗窃罪。这是因为，不满14周岁的孩子，年幼无知，不具备判断是非的能力。所以，他们所实施的危害社会的行为，刑法不追究刑事责任。
第二个阶段是已满14周岁不满16周岁的人，只对八种罪承担刑事责任，分别是故意杀人、故意伤害致人重伤或者死亡、强奸、抢劫、贩卖毒品、放火、爆炸、投毒罪。比如，15岁的小亮偷了别人的手机，由于盗窃并不在以上八种罪的范围内，所以他不用对盗窃行为承担刑事责任。但如果他所实施的是强奸行为，就要承担刑事责任了。
第三个阶段是已满16周岁的人，无论犯了什么罪，都要承担刑事责任。比如小亮长到了16岁，他再去偷别人的东西，就要承担刑事责任了。
第四个阶段是已满14周岁不满18周岁的未成年人犯罪的，应当比照成年人，从轻或者减轻处罚。这主要是考虑到未成年人可塑性大，易于接受改造，所以刑法对他们“网开一面”。
有的人可能会问，是不是没有达到刑事责任年龄的人干坏事法律就不管了呢?当然不是，《刑法》规定，因不满16周岁不予刑罚处罚的，责令他的家长或者监护人严加管教;在必要的时候，也可以由政府收容教养。而且，如果造成他人财产或者人身损害的，要承担民事责任。
