《刑法注释书(第三版)》修订说明
根据《刑法修正案(十二)》全新修订,并结合第二版出版以来刑事司法解释、文件、案例等的更新变化情况,除删除过时失效的内容外,增补、调整20余万字,具体修订情况如下:
1.新增内容:新增4个【相关立法】(新制定),1个【立案追诉标准】,10个【司法解释】,19个【司法指导文件】,8个【指导性案例·法院】,15个【指导性案例·检察】,3个【法院公报案例】,90个【法院参考案例】,9个【职务犯罪案例】,4个【审判实务释疑】。
2.新增栏目:新增2个注释栏目,即【立案追诉标准】和【职务犯罪案例】,【立案追诉标准】编选最高人民检察院、公安部关于公安机关管辖的刑事案件立案追诉标准,【职务犯罪案例】编选《职务犯罪审判指导》典型案例裁判要旨。
第三版除了增加上述栏目和内容外,还根据读者对前两版的反馈建议,对内容编排和正文版式作了以下优化调整:
1.编排优化:
一是以编者注的形式增加了200个对法律文件之间适用问题的提示性说明。为便于读者准确适用法律,对立案追诉标准、司法解释、司法指导文件、公安文件与刑法修正案之间,以及相互之间或各自之间的规定不一致的,着重予以指出、说明,并对法律文件中法条、罪名有新旧变化的情形,根据新的规定予以提示、列明。这些提示性说明均以编者注的形式作出,由第二版的111个增加到了第三版的311个。
二是调整了参考案例的排序方式。为了便于读者对同类案例的查询、比对,第三版对【法院参考案例】的排序方式进行了调整,从案例序号排列改为按所涉问题归类排列。例如,在抢劫罪项下的【法院参考案例】,将所有涉及“入户抢劫”的案例进行了集中排列。
三是增补了在前两版中有所疏漏的个别文件和案例。
2.版式优化:
一是对刑法条文加灰色阴影,便于读者识别哪些是刑法正文,哪些是注释内容。
二是在每页双栏编排的中间加一条细线,让左右区分更为明显。
三是将栏目序号中的拉丁数字改为阿拉伯数字,更加一目了然。如将【司法解释Ⅰ】【司法解释Ⅱ】改为【司法解释(1)】【司法解释(2)】。
四是对【法院参考案例】的序号、名称和所涉法律适用问题一并加黑,进一步凸显案件中的裁判要点。
