在谋求转变经济增长方式、减少地方政府债务的时代背景下，近年来，国务院及相关部委密集出台系列性政策文件，大力推广政府与社会资本合作（PPP）模式，地方政府也积极跟进，纷纷推介各类基础设施和公共服务项目，2015年因之被称为"PPP元年"。党的十八届五中全会进一步明确提出"创新公共基础设施投融资体制，推广政府和社会资本合作模式"、"创新公共服务提供方式，能由政府购买服务提供的，政府不再直接承办，能由政府和社会资本合作提供的，广泛吸引社会资本参与"。可以预见的是，在未来相当长一段时间内，政府和社会资本合作将成为包括城镇燃气供应在内的基础设施和公共服务供给的主导模式。尽管新《行政诉讼法》已将部分政府特许经营协议纠纷纳入了行政诉讼的受案范围之中，但由于PPP法制供给的不足和司法审查经验的匮乏，目前这类行政案件在我国司法实践中尚不多见，也使PPP改革面临着诸多法律风险。
